1L - Let's talk about the FYLSE a little.....
Recently I was attending a class on line, and a student (with an obviously superior intellect) posted the following statement. I swear I am not kidding here.
"I just don't understand all this fuss about the FYLSE. It's not that big a deal".
I almost fell out of my chair. Try telling that to the hundreds of students who have had to tackle this monster two, three, four, or more times in order to get past it.
If you were lucky enough to pass the first or second time, get off this site. You don't need it. But if you are part of the 82% (averaged) that had to repeat that wonderful experience, listen to this short podcast and I'll tell you what I had to do to get over the hurdle.
Of course, this is just my opinion.
By the way, this is what I looked like between re-takes three and four. No kidding, just ask my wife.

Studying for the bar exam
4. Stick to study habits that worked for you while you were in school. If your pattern was studying five hours a day, trying to work for 12-hour stretches may be counter-productive. Whether you take a bar review class or study on your own, take as many real-time practice essay tests as possible. Thousands of sample Multistate Bar exam questions are available. Whether your state drafts its own or uses the Multistate Performance Test (MPT) questions, find them all and practice, practice, practice.
5. Study groups are a gamble. Unless you are continuing with the group you have been in since Torts, finding an appropriate rhythm with strangers has the potential to detract from purposeful and productive studying.
6. Exercise and eat right. Meeting the pizza delivery guy does not count as exercise unless you climb down 30 flights of stairs to get it. Sugar, fat, salt, and caffeine are not food groups.
7. Do not talk to other test-takers for two weeks before the exam. Your friends will remember things that you have never heard of and they will confuse you with their notions of arcane issues of trust law. Don’t let yourself be distracted.
Taking the bar exam
8. Top tool: a wrist watch. You will not be able to use your cell phone’s clock, so beg, borrow, but do not steal a watch, and set it to 12 o’clock. Calculate the time allowed for each question, and write the time on your exam sheet. After one hour (1 o’clock) on a 60-minute question, you must move on. Whatever small number of points that you might earn for writing 30 minutes beyond that allotted time will not make up for missing a question entirely. You get no points for questions that you skip.
9. Read the questions. Read them again. Follow the instructions. If you are asked to write a memo to a client, do it. If you are hand-writing the exam and are instructed to write on every other line on every other page, do it. Whether writing or typing, know that a live person will read your answers. Make it as easy as possible for that person to give you points.
10. Using IRAQ, outline your answers, and do not start to write before you think carefully. The late Earle Kyle IV, who graded seven rounds of bar exams, often advised University of Minnesota Law School students that bar exam graders can tell if you write without a plan because relevant issues surface after you have dissected red herrings. You may get points for something on your outline. Can’t remember the law? He suggesting discussing the facts.
11. Telepathy is not a bar exam tool. Kyle advised students that their exams are graded against a grid. He noted that bar exam graders do not know what you know, and that test takers should write down everything. For a ConLaw question, write: “This is a Constitutional Law Question. [1 point] It involves state action [1 point].”

Wrestling is HUGE in the New Jersey-New York-Pennsylvania area. Just as big as high school football is in Texas or in Florida.
In fact, one of the moves that was popular during my high school wrestling days was the Lehigh ride, named after Lehigh (Pennsylvania) University wrestlers.
I went to wrestling camp in Bloomington, Indiana after my high school freshman year. I learned from Doug Blubaugh, the gold medal Olympic champion of 1960 (the same Olympics that Cassius Clay [Muhammad Ali] won the gold medal).
What I learned from Doug Blubaugh is that winning is a mental attitude. What separates a winner from a loser is the belief in one's ability to do what has to be done.
I heard an NPR radio show a few weeks ago about professional athletes who all possess roughly the same level of talent. However, some are winners and others are losers. Some pro athletes make the clutch play. Others choke.
What separates clutch from choke? Mental attitude. Someone--and I don't remember who--said that a clutch player is calm, cool, and collected and executes their game plan UNDER STRESS.
Choke players lose all their marbles under stress.

For those preparing for the October 2011 FYLSE California Baby Bar exam, you are spot-on for gearing up NOW!
When I was a kid, there were magazines full of puzzles and mazes. A maze would be complicated with a lot of dead-ends. I figured out how to beat the maze after a few attempts.
How do you beat a maze? Simple. You must start with the goal...and then work yourself backwards! Here's an example:

There is an effort by the Administration to make speech plain in these United States of America. That is a good thing.
There is a saying: “You can lead a horse to water, but you can’t make it drink.”
Dorothy Parker, the great satirist, wrote “You can lead a “horse” to culture, but you can’t make her think!"
Dorothy Parker was a laugh riot.
As far as the Plain English initiative by the Administration, this push is also evident in the legal world. Courts are becoming increasingly impatient with “high-horse” verbiage and pedantic blatherings spouted by know-it-alls who pontificate at length using legalistic jargon and convoluted obfuscations.
Speak plain English, please.
When I took the October 2009 FYLSE California Baby Bar exam, I first did my initial reconnaissance on the internet. I discovered that California Bar graders are NOT impressed with legalistic mumbo jumbo.
Firstly, these bar graders have better things to do with their time than to delight in some asinine drollery. Secondly, these bar graders are paid VERY little to grade exam books. Thirdly, these bar graders may have been born at night…but they were not born LAST night.
You just cannot think that you can pull a fast one on these bar graders.
Plain English is the way to go.
When I had done my initial reconnaissance, I determined that my October 2009 FYLSE exam books were going to be crisp, clear, and to the point.
I did NOT take professional bar prep training. I did NOT use a laptop. I DID pass the October 2009 FYLSE on my very first attempt. I flew from New Jersey to Ontario, California to test.
I understand that only 19% of the total test-takers in Ontario and in San Francisco actually were successful. The moral of the story here is that being “average” and being “ordinary” meant that you did NOT pass the exam.
I am NOT getting on my “high-horse” about this. Any “high-horse” in my stable has long been shot and sent to the glue factory or to the dog-food packing plant.
In fact, in this post, my intention and purpose is to encourage and uplift. My objective is NOT to discourage and break down.
High falutin fancy-pants antics are great over cocktails at dinner with friends, but bar graders are NOT impressed with legalistic mumbo jumbo.

Called The Plain Writing Act, it is particularly intended to make it easier for Americans to make sense of benefit applications, and hopefully their tax forms. You Don’t Have To Know All The Law
The fear of not knowing enough law should not prevent students from taking practice examinations. Practice examinations will enable students to start applying the legal theories that have been studying.
If an issue is missed in an examination, the student can go back, review the facts of the question, review the model outline and/or answer and determine at that point why the issue was missed.
In fact since these are practice examinations, why not keep study materials open and available so if an area of law has not been mastered, it can then be reviewed on the spot.
The lesson here is even after spending several weeks studying an area of the law; if issues are missed in an examination, zero credit will be awarded even though the material had been well studied. The earlier this examination process is understood, the more efficient students will become in writing their answers.
There is an old joke that fits this premise. A tourist stopped an old man on the road in New York and asked the old man, “How do you get to Carnegie Hall?” The old man replied, “Practice, Practice, Practice.” The practice of writing essay examinations is similar to that of learning how to ride a bicycle in that the required skills are not inherent but have to be learned. A child begins learning to ride on a big wheel or some low riding plastic bike that allows small feet to touch the ground. In time, a tricycle is introduced and soon after a two-wheel big bike with training wheels comes out of the garage. After many, many afternoons of patience and practice, the training wheels are removed only to allow the child the greatest feeling of freedom riding the two-wheel bicycle with confidence and style.

Thanks for the valuable insights, and now back to the writing of more essays. And the continued finger exercises needed to type quickly during timed tests.
As you know from having spent such a considerable amount of time working on the FYLSX and assisting those of us who are in the process of passing the test...Practice, as you have mentioned is vital. For thus of us not in the legal profession, and who work full time in another profession that does not use legal analysis on a daily basis...the type of writing used to pass the FYLSX is different and requires a different mind set...One has to have the writing in an acceptable format on the first pass...It is not a draft...Drafts are not allowed... other than what is on your scratch paper. The essay is the final document and has to read in an acceptable manner on the first writing. Most of us in a business other than law, have been trained to write drafts and then rewrite to hone the discussion and come up with a final document. Which includes a conclusion in an executive summary type of format...This is a problem on the FYLSX and a stumbling block to those of us who write business memos and other business correspondence.
Why...?
The FYLSX does not give you the option to write in draft mode because of the time constraints.
What works...? I am still working to answer this question. Thus far I have this to add...
The ability to outline is vital, the outline should name the parties, identify their issues, create the laundry list, expand upon it and then state the rationale for how the facts within the given pattern lead towards the majority position or in some instance the minority position and then discuss the probable outcome based on these traditional positions. Thus we are not discussing a conclusion in the traditional sense, but a legal standing...The word conclusion in IRAC is misleading...
There are my two cents in the world of the FYLSX.

The June 2011 FYLSE Baby Bar exam is almost here...are you ready?
As I've mentioned before, my son, who is scheduled to graduate from college this year, once asked me why I never taught high school. And, the look on my face gave him his answer.
To those high school teachers among us...you have my sympathies! There is no way in heck that I can imagine myself teaching some arrogant, cocky, lazy, good-for-nothing who feels privileged and entitled to everything and anything.
Okay. Back on point. The June 2011 FYLSE Baby Bar exam is upon us.
Are you ready?
Do you know your elements?
I mean really, really, know your elements?
Okay, then. Pop quiz: What are the elements of burglary?
Remember, that it is NOT good enough just to be familiar with the elements. Kinda sorta is just NOT good enough. In the military, there was a specific name for those troops who were kinda familiar with a task...dead troops.
Being kinda sorta familiar just ain't good enough.
You've got to know your elements until you can do them in your sleep.
Okay. Here are the elements of burglary off the top of my head. Maybe I've left out one or two, but my recollection is probably still good for taking the FYLSE...if I had to do it over again. Thank God I don't!
Burglary is the
(1) trespassory
(2) breaking
(3) and entering
(4) of the dwelling house
(5) of another
(6) at night
(7) with the intention to commit a felony
(8) therein.
Those are the elements of burglary, as I remember them off the top of my head. If you get a fact-pattern with burglary involved, then be prepared to prove up each and every element. If there is an element or two missing, then be prepared to ANALYZE that darn fact-pattern and EXPLAIN why.
Leave nothing to chance.
I burned these elements into my brain as I prepared for the October 2009 FYLSE California Baby Bar exam.
It was the first, and only, time I had to take the FYLSE.

NEW YORK/CHICAGO (Reuters) - MF Global fired all 1,066 of its brokerage employees on Friday, triggering anger and resentment about the firm's collapse after bad bets on European debt under former CEO Jon Corzine's leadership.
How the abrupt, final blow was delivered upset many staff -- with some learning by e-mail and others through news on the television.
"Fifteen years and no severance!" shouted one angry MF Global employee as he left the firm's offices on 5th Avenue in Manhattan after hugging the receptionist and doorman.

What Makes the Baby Bar so Difficult?
The pass rates for the California Baby Bar or First Year Law Students' Exam are low. The typical pass rate for the state is often under 20%. Students fail because they have not yet acquired the requisite analytical skills necessary to achieve a passing score on the baby bar exam.
While many who fail the baby bar exam believe that they simply need to go back to reviewing the substantive law, usually an examinees' failure is due to weaknesses in their legal writing and analytical skills.
It takes more than just memorizing black letter law
The baby bar exam not only tests your substantive law knowledge, it goes much further in that examinees must successfully demonstrate legal analytical skills such that the examinee can:
properly identify the relevant legal issues in each essay exam;
resolve the relevant legal issues by providing a detailed and thorough application of the relevant legal principles;
reach logical conclusions that are supported by the law and facts; and
establish a proficiency in the substantive legal areas tested (torts, criminal law, contracts and the U.C.C.) by achieving the required passing score on the multiple choice section of the baby bar exam.
Therefore, in order to be one of the 20% that are successful each year on the baby bar, you must develop the required writing and analytical skills and of course, learn, understand and memorize the substantive law.
Successful baby bar candidates go much further than simply memorizing rule statements and checklists. While memorization is extremely important, so too is practical application of the law. It is critical to your success on the baby bar exam that you practice each section of the test repetitively in order to develop the required level of proficiency.
Remember, you will not be called upon to write an outline on exam day. Instead, you will be required to read a fact pattern, identify all of the relevant legal issues, resolve each legal issue with a thorough application of the law and come to a logical conclusion that is supported by both the facts and the law. To master these skills takes a lot of practice and requires far more than just memorizing the black letter law. One of the most difficult challenges of the Baby Bar is to be able to identify the issues and to write a successful answer within the allotted time frame.

National Public Radio has this excellent show on Sunday nights at 8pm EST following "This American Life." The program has a host, David Garland, who brings on live talent, not yet famous.
GLASS GHOST is one of those groups that I heard on David Garland's program, "Spinning on Air."
Tonight featured MARK DAVID ASHWORTH, a great guitarist-singer who sang a really, really melodically wonderful duet with a female singer...but I didn't catch the title of the tune (maybe they'll re-run the program late tonight).

As you are polishing up our test-taking skills for next month's FYLSE California Baby Bar exam, you need to have confidence. The USMC motto is Semper Fidelis. A loyal canine is Fido. The faith you have in yourself will carry the day.
What develops that faith in yourself, that confidence? That, my friends, is an inside job. Only soul-searching answers that question. As they say in sports, you have got to do your own gut-check. You need to search your soul and find that inner confidence.

Even the best of us have a crisis of confidence at times. My favorite baseball team, the New York Mets, are perennial losers...but I love them because I'm a fool...and a true fan. Anyway, the Mets had a relief pitcher in the early 1970s named Tug McGraw who's son is a Country and Western music star today. Tug McGraw coined this phrase that still rings true today: "You Gotta Believe!"

Never Get Greedy.
There is an observation that has held up true for many, many years: Never get greedy.
This has become a mantra for me and my friends. If you look carefully at some of the most spectacular down-falls...these exercises in hubris and stupidity have resulted from folk getting too darn greedy.
In fact, it is my observation that only the ingratitude of folk exceeds their stupidity and greed. People are too selfish and too stupid to care.

Woman puts up $7,200 to aid customers in CA store

OCEANSIDE, Calif. – A woman with a foul mouth, fat wallet and dislike for men bought $7,200 worth of clothing for more than 50 women at a Southern California discount store.
Claudia Smith, 66, showed up at the Everything a Deal store in Oceanside on Tuesday night and bought $2,200 worth of clothing for the few customers in the store.
Store manager Paola Garcia said when Smith first came in, she told customers to buy whatever they wanted. They grabbed everything they could get their hands on in the store where nothing sells for more than $9.99.
"They were greedy," Garcia said.
Smith lived in San Felipe, Mexico, for several years and wanted to buy things for poor Mexican women, she told the San Diego Union-Tribune.

I would like to thank you for your great website. Your site was an important resource for me. I completed the baby bar exam this past Tuesday. I would like to discuss reflections on the October 2009 FYLSE with those who took the exam.
Because I am limited to 3000 characters, here are the first two questions as I remember them:
Essay One: The Political Rally
The facts were that, at political rally attended by 1,000 people, the organizer at the event (in support for a challenger to the mayor) made defamatory comments about the wife of the current mayor. Based on "largely false" information he heard from a notorious gossip, he told the crowd that the mayor's wife was a snob and a cutthroat who blocked her personal friend's membership to a private women's club. The mayor's wife had actually supported her friend's membership. The mayor's wife had appeared in public for the first time two days before the event. The call of the question asked (1.) about the claims of mayor's wife and (2.)the organizer's defenses.
Essay Two: The Laptop Theft
In trying to recover a gambling debt, a principal sent an email to his agent friend instructing her to recover the debtor's laptop from the debtor's house. The principal led the agent to believe that the laptop belonged to the principal. In the email, the principal told her where to find the key under the doormat to the debtor's house.
The email was intercepted by a third party, without knowledge of the others. When the agent arrived at the house, the door was open and the third party was ransacking the house. The agent entered through the open door and startled the third party. The third party slipped and fell, banged his head on a table, and ran away.
The agent searched the house, found the laptop, and decided she wanted the laptop for herself. She put the laptop in her purse. The agent called the police. When the police arrived, the agent said that the third party stole the laptop. When the police went to the third party's house, they found him dead.
The call of the question asked us to discuss the crimes and the defenses.

IRVINGTON — A victim who calls for help in a dangerous setting could be held responsible for a Good Samaritan’s injuries if there wasn’t proper warning about the perils of the situation, a state appellate panel ruled today.
The decision by the three-judge panel reinstates a lawsuit filed by the family an Irvington man who was killed after coming to the aid of a neighbor whose apartment was being robbed in 2003.
The case stems from the Sept. 3, 2003 shootings of Naitil Desir and Cosme Novaly during a robbery of the office of Vertus Financial Services, an apartment that was also the home of company owner Jean Robert Vertus.
The executor of Novaly’s estate sued Vertus and his company, alleging Vertus was liable because he did not warn Novaly he suspected his apartment was being robbed as he asked for help.
According to the decision, Vertus, who had a check-cashing business, was first alerted to something out of the ordinary when he escorted a client to the door. Instead of following the client out, Vertus went down a set of side stairs to seek help from a downstairs neighbor. When that neighbor didn’t answer the door, Vertus went down the street to a building where Novaly, a customer and a friend, lived, according to the decision.
Vertus initially asked to use Novaly’s phone to call his office to determine whether anything had happened. While he was on the phone, Novaly and his roommate left the apartment to head to Vertus’ building.
Vertus said in court papers he suspected his apartment was being robbed but he didn’t share his suspicions with Novaly or the roommate. He said he told them "something was going on."
When he returned to the building, Vertus found Novaly lying on the ground with a gunshot wound. Novaly died 24 days later.
"We hold that one who has reason to believe that an intruder on his premises poses a danger to others OWES A DUTY OF REASONABLE CARE to a friend whom he brings to the danger by a request for assistance," wrote appellate judge Jane Grall.

One great thing about growing old is that, eventually, you can spot the musical rip-offs.
Case in point: Parliament-Funkadelic's George Clinton literally stole from Iron Maiden's Ozzy Osborne. What led me to this evidence was pure nostalgia. I wanted to hear Iron Maiden's epic tune, "Iron Man," and right in the middle of it I heard the opening riff from Parliament Funkadelic's "Standing on the Verge (of gettin' it on)."

Here are Questions 3 and 4:
Essay Three: The Luxury Boat
A luxury boat company sent an unsolicited mailing to a prospective customer for an all-expenses paid trip to a hotel next to where a luxury boat was being offered for sale. The customer came and looked at the boat. The salesman claimed that the boat was "state of the art" and at the best available price. He gave her a form to which he had written the name of the boat in the blank. He wrote her name on the form as well. In red italics above the customer signature line, there was a statement such that "This offer is made with the understanding that it is accepted only after the Luxury Boat company approves the sale."
The customer took the unsigned form home. A week later, she searched the internet and found out that the boat was not the best price. She still decided to sign the form and she faxed it back to the company. Another week later, she did more research and found out that the boat was a discontinued model. She faxed a revocation. The same day she received in the mail the form she had signed. It was stamped "approved" by the company.
The call of the question asked what were the Company's claims against her and on what theories.
Question 4: The Loud and Violent Teen
A minor had gotten into trouble for disruptive behavior in school. A psychologist hired by the school assessed the minor and determined that he had a 90% chance of committing violence on someone in the future. The parents ignored the warning and sent the minor to stay with his uncle.
At the uncle's house, the minor loudly played his guitar. The noise disturbed a neighbor who was a therapist counseling patients in his home. The therapist complained to the uncle. The uncle told the minor to lower the volume. The uncle had to leave the house one day and told the minor to keep down the guitar's volume. When the uncle left the house one day, the minor cranked up the volume. The therapist came over and asked the minor to turn it down. The minor told him off.
As the therapist was leaving the minor threw a large heavy rock at him. The rock missed the therapist but hit a woman walking by. The woman sustained serious and permanent injuries.
The call of the question asked for: (1) The therapist's actions against minor, (2) The therapist's actions against the uncle, (3) The woman's actions against the minor, and (4) the woman's actions against the minor's parents.

I'm listening to my daily National Public Radio (NPR), and there's an interview with a film maker named Tom McCarthy.
Later on this month is the debut of Tom McCarthy's film "Win Win," starring Paul Giamatti.
Giamatti plays a lawyer who is also a wrestling coach. "Rocky," the character written and acted by Sylvester Stallone, had a brother-in-law, played by Burt Young.
In "Win Win," Burt Young plays the grandfather of Kyle, the star wrestler who comes to Giamatti's team.
Kyle is played by Alex Schaefer, a real-life New Jersey wrestler who just won the New Jersey state championship at 119 pounds.

Best of outcomes to you and th FYLSE study group. A great advantage that distance learning with today's technology is the ability to rapidly access and disseminate information.
The only caveat I would caution you and others in your group is to beware of those who want to hitch a free ride without contributing anything substantial. That hazard must always be dealt with in study groups.
I did not belong to a study group. That was not my intention (to go it alone). That was reality of choices I had to make.
Results for the October 2009 FYLSE California Baby Bar exam are being mailed to us in five days.

You guys are going to hate me, but I passed on the first time too!! But only by the skin of my teeth! I managed to get a score in the mid 80's on the MBE's but only a 60ish on the essays. My practice essays were much higher as were my exams!! So these guys just want to fail you, no joke!
So all I can say is these bar graders tried to fail me. They did everything they could. So be prepared guys, because those essay graders are just brutal and not to mention cruel. Oh and practice those MBE's they may just save you, because the cruelty of the graders can't get you on the MBE's. (At least not as directly.

I would love to help. I am just glad to be a 2L at last. Having to redo my 1L year because I transferred from an ABA school was bad enough. I was just glad I didn't have to go through your ordeal Nelson. Two years of Contracts was too much, that's for sure!
Oh and as I said, if you need any help just let me know.
Oh and on a related subject, I still think it would be a good idea to get the Cali Legislator to make ABA students take the Baby Bar too. If everyone had to take it, I am sure the ABA people would make the test passable and fair.

That little digression about the look I gave to my son when he asked me about why I never taught high school reminded me about this fictional tale I heard:
Bill Gates, founder of Microsoft Corporation, was bored. He had accomplished most of his professional goals and he had made a lot of money.
He wanted more of what life had to offer. Someone told him of the wisest man in the world who lived high up in the mountains in Tibet.

I just want to emphasize that you are in the right place. This site, with the sagacious wisdom of Mr. Mystery Web Guy (whom I don't know...but whom I owe LOTSA beers!)...I was able to clear the hurdle of the October 2009 FYLSE on my first attempt.

Today, the NY Jets play for a shot at the Super Bowl.
New York is a sports power-house. Just ask the folk in San Francisco. In 2010, they won a World Series Championship...thanks to a cast-off New York team called the Giants.
1969 was a magical sports year for New York. The Jets, the Mets, and the Knickerbockers all won championships. Actually, I'm a Jets-Mets-Nets fan--only because the New York Knicks brought in "Mr. Softee," Patrick Ewing (over-rated soft touch big man).
The Knickerbockers were led by Captain Willis Reed. A future U.S. Senator, and Princeton grad (and Rhodes scholar) "Dollar" Bill Bradley was on the squad. Walt "Clyde" Frazier was a sure-shot. Earl "The Pearl" Monroe came later. And, of course, a New York Knickerbocker would later become a messiah for California--Phil Jackson, a gangly, spindly-armed flopper, who would later lead the Los Angeles Lakers to victory after guiding Michael Jordan and his Chicago Bulls.
Today we honor the J-E-T-S...Jets! Jets! Jets!
They'll probably lose. We're used to it. Just like Boston was used to its perennial losers ever since they traded George Herman "Babe" Ruth to the New York Yankees. By the way, like all TRUE Mets fans, I HATE the NY Yankees!

CLEARWATER, Fla. – "A day before his final mission aboard a B-17 bomber in World War II, Norbert Swierz sat down on his bunk and jotted down a poem for his mother back in Michigan.
"I go so gladly to my fate, whatever it may be. That I would have you shed no tears for me," wrote the 23-year-old gunner, who had already survived the ditching of his first B-17 in the North Sea that summer of 1943. "Some men must die, that others must be free. And only God can say whom these shall be."
The next day, Sept. 6, 1943, "Skeets" Swierz and the rest of the crew of the B-17 nicknamed "Bomb Boogie" took off from their base in England, but didn't make it back. Shot down and taken prisoner, Swierz would spend the rest of his war days in a POW camp and not fly in another B-17 for close to 70 years.
The opportunity came again last Friday, and Swierz didn't hesitate. He strapped himself into a restored Flying Fortress and held on as the four droning engines lifted the vintage bomber off a central Florida airstrip into heavy cloud cover.
"Wonderful," the grinning 90-year-old man kept saying during the 45-minute flight. "Wonderful."
Strapped into the radio operator's chair halfway back, Swierz looked around and reeled off the name of the man on his crew who occupied the same seat on his old plane, and the name of the gunner who had squeezed into the ball turret underneath. That's what he was thinking about most, the other guys.
"They're all gone now, but I still have the memories," he said. "They were all kids then, just like myself."
Swierz's flight came courtesy of the Collings Foundation, which tours the country with several planes restored to their World War II condition. More than 12,000 B-17s were manufactured for the war effort, and the Massachusetts-based charity owns one of a handful around the world that can still get off the ground. Foundation spokesman Hunter Chaney said it's important to put the old veterans together with the vintage aircraft while that's still possible."

The June 2011 FYLSE Baby Bar exam requires a little thought and some advance planning. Every soldier, marine, sailor, airman, and guardsman knows that you just HAVE to do your reconnaissance if you want to be successful in your military campaign.
Treat the FYLSE as a military campaign. You have a clearly-defined objective: You MUST pass!
The logistics of your campaign require advance planning. Don't wait until you get to Pasadena or Oakland to try to scrounge up and cobble together a half-baked mission on the fly. Know in advance what you must do.
(1) Get a nice hotel room.
I used priceline.com to get a GREAT room at a hotel that offered free hot breakfasts and free happy hours!

The hot breakfasts were exactly that...HOT! No "continental" breakfast fare with just cold cereal and orange slices. We're talkin' bacon, eggs, sausage, french toast with maple syrup, hot oatmeal, SOS (esso ess is what we called it in the military...creamed beef on toast AKA "stuff"-on-a-shingle--hence, SOS), jams and jellies and all the fixins!
Call around to the available hotels and find out which ones have the good grub!
(2) Locate the convenience stores.
You're gonna have to buy incidentals and stuff you forgot to pack.
(3) Locate where your Law School's review/seminar is being held.
You do NOT want to skip this ESSENTIAL class!
(4) Locate where you're going to have lunch during the break after the four-hour morning essay session.
You do NOT want to hang around the other test-takers who are freaking out over the morning essay questions!
(5) Do logistics on how to make your trip home.
Always do your homework! Plan your exit strategy!

Good nutrition is vital to a healthy, well-functioning brain. Breakfast is a GREAT start to the day.
I prefer to cook my own breakfast. However, when out of town and needing a quick break to a famished fast, sometimes a fast-food eatery is the only option.
Some people swear by McDonald's. I like their Big Breakfast. Not quite big enough for my taste, but it gets her done.
Some people swear by Burger King. I find their croissants too cake-y and/or flour-y. And another thing, that Burger King is an odd character. Check out this video. There is something ODDLY uncomfortable about having the Burger King waking up with you:

I remember when boxing used to be a big-time sport. Howard Cosell would call the fights on WABC television. Anyway, the greatest boxer back in the late 60's and 1970's was The Greatest, Muhammad Ali.

I remember seeing a documentary, at that time, of Ali trudging out early in the morning to do his 5 AM work-out. I remember Dick Cavett, the television host, recalling how he went to Ali's training camp in the Pennsylvania mountains. Dick Cavett said that he saw Ali's training boots lying on the floor and tried them on. Mr. Cavett said that he could barely walk in them. Muhammad Ali's boots were weighted with lead!
When Ali was jogging, his boots just looked like a pair of training boots to the uninformed gawker. They were lead-weighted boots that added tens of pounds more to his jog.
The point is that the "Ali Shuffle"--his quick foot-work in the ring before he knocked out an opponent--was not a fluke.
Ali trained.

It never ceases to amaze me how stupid people can be. Especially when they're law STUDENTS. We are students. We don't give legal advice. That is, unless we are:
(1) arrogant and/or
(2) incompetent and/or
(3) stupid.
When someone asks me for my legal opinion, then I have a standard answer: Get yourself in the office of a good lawyer. Period. End of story.
I am NOT:
(1) a lawyer
(2) covered by legal malpractice insurance
(3) and getting paid for my opinion.

For at least two years, Seth Davenport acted both as Montville’s municipal court judge and as an informal legal adviser to the township’s then-mayor, a state advisory panel has alleged.
He then misrepresented his relationship with Mayor John Rosellini in a sworn statement filed with state Superior Court in Morristown, according to a complaint issued late last month by the state’s advisory committee on judicial conduct.
Davenport did not return calls seeking comment but, according to the complaint, has admitted to the advisory committee his conduct had been "improper."

I am a beer fan, myself. Of course, Congressional Medal of Honor Marine, Dakota Meyer, deserves a few kegs of whatever brew he darn well enjoys!
However, if I were President of the United States then beer would be way down on my list of priorities. Furthermore, I would NOT spend time inquiring into domestic spats involving a hot-headed Harvard professor and a Boston cop, much less would I even want to have a beer with them at a so-called "Beer Summit." at the White House with the Vice-President.

WASHINGTON (AP) — President Barack Obama has shared a beer with Dakota Meyer at the White House the evening before presenting the former Marine with the Medal of Honor.
The White House revealed the private moment shared by the two men Wednesday evening on the patio outside of the Oval Office. A White House ceremony to bestow the medal to Meyer is set for Thursday.
Meyer saved 36 lives during an ambush in September of 2009 by insurgents in Afghanistan. He is credited with saving 13 Marines and Army soldiers, along with 23 Afghan soldiers. The military says Meyer personally killed at least eight insurgents despite being wounded himself.

Last night's World Series game between the Texas Rangers at the St. Louis Cardinals was one of the greatest comebacks in baseball history! It was accomplished by perserverance and stick-to-it-iveness! Preparation for the California FYLSE Baby Bar exam is similar to baseball in that you have to methodically, assiduously, relentlessly focus and prepare!
Baseball is the most unique of all America's sports. Baseball--unlike football, basketball, or hockey--does not have a time clock. A baseball game can last for hours on end until (1) completed or (2) until the officials suspend play until a time when the game may be resumed. Baseball is a team sport. Coaches and managers are integral to the game and can stop play in order to discuss strategy with individual players.
Although baseball is a team sport, individual statistics count for so much. Mention the number 714 or the number 755 and every baseball fan knows to what individual statistic you are referring. Perhaps the most unique feature of baseball--unlike in other sports such as football, or basketball, or hockey--is that the defensive teamn has possession of the ball duing play.
As a sport created in America, in Hoboken, New Jersey, (also the birthplace of Frank Sinatra!) baseball has been identified strongly with the positive qualities often attributed to American inventions such as jazz. Baseball has strategy, focus, determination, ingenuity, and improvisation.
By pluck and by luck , by grit and wit, by stick-to-it-iveness and sheer determination, by believing in yourself and in your team, contributing your talents and drive, you as a baseball player can achieve glory!
Though baseball has no final bell, as in boxing; no final gun, as in football; no final buzzer as in basketball; no final horn, as in hocky; baseball DOES have one of the most dramatic, and most beautiful, of all storybook endings: the walk-off homerun, where an individual player, through timing and execution, tracks a 100-mile-per-hour baseball thrown at him, and smacks it over the fence.

Studying for the bar exam is boring, monotonous, tiring, and generally unpleasant. I’m a person who enjoys learning, and generally enjoyed law school. However bar study is nothing like law school, and loving to learn will not make the bar exam study process enjoyable. Instead, bar study simply consists of cramming black letter law into one’s brain, glossing over the intricacies. That is because the bar exam tests many areas of law and asks only superficial questions, to which the bar exam taker must respond with a superficial answer.
This sort of tedious studying for two months isn’t fun by any stretch of the imagination. Some bar exam takers apparently find it difficult to stay focused – however I had no problem staying motivated and on schedule, thanks to one simple thing:
FEAR.
Whenever I felt like slacking off, I just took a minute to envision myself failing the bar.

I was chatting with Kevin and his friend and the topic of sports came up. I (innocently) asked Kevin what teams he rooted for.
Kevin and his friend turned and looked at me as if I was a three-headed alien from outer space.

There's a great scene in the movie, "Thelma and Louise," in which Harvey Keitel plays a detective who's trying to track down Thelma and Louise for a homicide they committed while being raped. The cops are having a hard time finding them and a young lieutenant remarks to Keitel that Thelma and Louise are either very smart or very lucky.
Harvey Keitel replies that "Smarts only gets you so far. And your luck ALWAYS runs out."
President Obama is a very smart man who's luck seems to have run out.
On National Public Radio last week, I heard a program discussing Coping versus Adapting. The presenter explained that Coping is when you roll with the punches. Adapting is when you adjust your strategy to changing circumstances, and then when you counter-punch and strike back for the WIN. Muhammad Ali was the Greatest of All Times (as he liked to boast) because he could adapt. President Obama is good at coping. Coping leaves one "adequate" or "sufficient" but NOT a winner.
That said, the FYLSE California Baby Bar exam is NOT about winning. The FYLSE is about coping. One sure way to fail the FYLSE is to go into the exam trying to pass. You do NOT try to pass the FYLSE. In order to win, you MUST try not to fail.
This is counter-intuitive, but in my opinion, this is the situation you have to deal with. My opinion is based on my experiences. To win on the FYLSE requires that you try not to fail.
(1) The FYLSE is pass/fail.
(2) The FYLSE is graded in two parts, one essay and the other multiple choice. The essay part is graded by attorneys. Good luck with trying to impress them!
President Obama is a smart man. Barack Obama WAS the editor-in-chief of the Harvard Law Review. In law school, Mr. Obama was at the top of his game. However, President Obama is NOT a rocket scientist.
As a matter of fact, President Jimmy Carter WAS a nuclear physicist. Both President Obama and President Carter are accused by some critics of being losers because they try NOT to lose.
There is a good reason--in my opinion--why President Obama did so well in law school. There is a good reason why he became editor-in-chief of the Harvard Law Review. Harvard Law School is considered by many folk of being THE premier law school of ALL law schools.
President Obama plays NOT to lose.
My theory is that, in order to be successful on the FYLSE California Baby Bar exam, you must try NOT to fail. But, you should NOT try to win.
Trying to win is reserved for those trying to be a champion or a hero. Do NOT try to be a hero on the FYLSE (if you want to win!).
